This petition has been filed under Section 438 Cr.P.C. seeking anticipatory bail in case FIR No.135 dated 28.08.2023, registered under Sections 323, 452, 506, 148, 149 IPC (Section 325 IPC added later on), at Police Station Dhanoula, District Barnala. 2.
On 04.10.2023, the petitioner was directed to join the investigation and cooperate throughout and on doing so, the petitioner was directed to be released on furnishing personal bonds and surety to the satisfaction of the Arresting/Investigating Officer. Thereafter, on 29.07.2024, the following order was passed:- "Learned counsel for the petitioner submits that it is a case where three persons from the side of accused also sustained injuries in respect of which there is no explanation in the FIR. Learned counsel in this regard has drawn the attention of this Court to Annexures R-5, R-6 & R-7 annexed with reply dated 21.03.2024 filed by the State. CRM-M-50056-2023 Learned counsel further submits that the dispute in fact is in respect of a passage and that the same can be amicably sorted out amongst the parties. Learned counsel submits that he shall get a site plan of the disputed passage prepared so that both the parties can put forth their stand in respect of the same.
In view of the aforesaid submission, both the parties are directed to appear before the Secretary, DLSA, Barnala on 07.08.2024. The Secretary, DLSA, Barnala shall refer the parties to some seasoned Mediator for exploring the possibility of an amicable settlement.
List again on 07.11.2024.
Interim directions, if any, to continue.
Both the parties shall get their respective site plan of the disputed passage prepared and produce the same before the Mediator."

The report of the Mediator has been received, which indicates that mediation between the parties has failed. 4.
Learned State counsel, on instructions from SI Rajinder, at the very outset, informs the Court that the petitioner has joined the investigation and his custodial interrogation is not required. 5.
In view of the statement of learned State counsel, order dated 04.10.2023 is hereby made absolute. The petitioner shall abide by the terms and conditions envisaged under Section 482(2) of BNSS (erstwhile Section 438(2) of the Code of Criminal Procedure, 1973). 6.
The petition stands disposed of.
