Present petition has been filed praying for issuance of direction to respondents to deal with the cancellation/untrace report, if any, in case FIR No.120, dated 31.05.2022, under Sections 406/420/467/468/471 and 506 IPC, registered at Police Station Sadar Bahadurgarh, in accordance with the directions issued by this Court in Jasveer Singh vs State of Punjab passed in CRM-M-44143-2020.

Learned counsel for the petitioner submits that petitioner is the complainant of above-mentioned FIR, in which tainted investigation has been carried out. He submits that though it is said that cancellation/untraced report has been prepared, however, even that is not presented before the Court of competent jurisdiction till date.

On asking of the Court, Mr.Sumit Jain, Additional Advocate

CRM-M-49561-2024 -2General, Haryana, who is present in Court, accepts notice on behalf of the respondents/State and submits, on instructions from ASI Jasbir Singh, that cancellation report has already been prepared and the same will be filed before the concerned Illaqa Magistrate within two weeks after seeking approval from concerned Superintendent of Police. 5.

In view of the statement made by learned State counsel, the present petition is disposed of with a direction to the respondents to file the cancellation report within two weeks from today and in case any cancellation report is filed before the Court, the concerned Court would issue notice to the petitioner and thereafter would decide the same in accordance with law.
