RITU BAHRI J. (Oral) At the very outset, learned counsel for the appellant has placed on record the affidavit of Santokh Singh to the effect that before the Mediation Centre of this Court, the matter was compromised between the parties on 25.02.2015 and he had tendered an account payee cheque of his son Javind Singh bearing No. 456727 dated 25.02.2015 for a sum of Rs.3,35,000/- drawn on O.B.C, P.O Jalalpur Distt. Hoshiarpur in favour of respondent No. 1, which was accepted by him as full and final dispute of the entire claim and dispute. The said had also been encashed on 28.02.2015 and further the execution petition filed by respondent No. 1 has been withdrawn by him, in terms of the compromise.

In this view of the matter, learned counsel for the appellant wishes to withdraw the present appeal with a GAURAV 2015.03.31 13:08 I attest to the accuracy and integrity of this document

R.S.A No. 5597 of 2014 -2prayer to refund the court fee deposited by him along with the appeal.

Dismissed as withdrawn.

However, the court fee deposited by the appellant be refunded to him, as per Rules.
