Seeking grant of special leave to appeal against the order of acquittal dated 05.11.2014 passed by the Judicial Magistrate Ist Class, Chandigarh, applicant has come up before this Court by filing the present application. 2.

On the last date, this Court passed the following order:- "As per report of Registry, notice could not be issued to the respondent for want of correct address.

Let the correct address be filed within one week. On doing so, fresh notice be issued to the respondent returnable for 18.12.2024.

If the correct address is not filed, then on the next date of hearing, the present leave to appeal shall be dismissed for nonprosecution." 3.

Counsel for the applicant submits that they do not have correct address of the respondent-Harnek Singh.

Given above, the present application for leave to appeal is dismissed for nonprosecution. Liberty reserved to the applicant to file a fresh application as and when he get address of the respondent after explaining the delay, if any. It is clarified that the time for which the present application was pending before this Court, shall not be counted for the purpose of limitation. It is further clarified that disposal of the present application shall not come in applicant's way if he files a fresh, however it shall not be permissible for the applicant to file application for revival of the present application.
