Present appeal has been preferred by the plaintiffs challenging the judgment and decree dated 02.02.2011 passed by the Trial Court and the judgment and decree dated 12.11.2013 passed by the First Appellate Court. 2.
Present appeal has been preferred alongwith an application (CM-340-C-2020) for condonation of delay of 2074 days in filing the present appeal. The First Appellate Court passed the judgment and decree on 12.11.2013, however, certified copy of the judgment and decree was applied for only on 21.09.2019 and thereafter, present appeal is stated to have been filed.

Learned counsel for the applicant-appellants has contended that the counsel was engaged in the present case in the second week of November 2017 for filing the regular second appeal, however, due to illness of his clerk and thereafter, his own illness, the appeal could not be filed. CM-340-C-2020 and RSA-133-2020 (O&M) -2However, there is no explanation whatsoever for the long delay from 12.11.2013 to November 2017. Learned counsel for the applicant-appellants states that there is no reason stated in the application explaining the delay from 2013 to 2017.

In view of the above, the application for condonation of delay is dismissed. Consequently, present appeal is also dismissed.
