ANIL KSHETARPAL, J (Oral) Defendant is in regular second appeal against concurrent findings of fact arrived at by the Courts below. Plaintiffs had filed a suit for partition of the property. In view of the judgment passed by me today in RSA No.681 of 2011, the parties would remain co-owners. The Courts below have passed a preliminary decree for partition. Such finding is not shown to be erroneous. In these circumstances, this appeal is also dismissed.
