Plaintiff-appellant has challenged the demand of 3,93,708/- raised by the defendant-respondent herein through Memo No.1111 dated 26.07.2013 in respect of an electricity connection. The stand of the defendant was that impugned bill was raised as plaintiff was found to be committing theft of electricity. Both the Courts below have dismissed the suit.

Recently, a Division Bench of this Court in RSA-4181-2016 titled Mahesh Kumar Vs. Sub Divisional Officer and another and connected matters, decided on 14.05.2025, has held that in such like matters, jurisdiction of the Civil Court is barred. In view of the aforesaid circumstances, the present appeal is hereby dismissed as the suit itself was not maintainable on account of the fact that jurisdiction of the Civil Court was barred. However, liberty is granted to the plaintiff-appellant to avail the alternative remedy available with him, in accordance with law.
