Having preferred instant appeal, appellants-State of Punjab has assailed the concurrent findings recorded by both the courts below whereby suit of the plaintiff-respondent was decreed vide judgment and decree dated 31.07.2012 passed by learned Addl. Civil Judge (Sr. Division), Amritsar and appeal filed thereagainst has been dismissed vide judgment dated 10.07.2014 passed by learned Addl. District Judge, Amritsar.

At the time of hearing today, learned State counsel, on instructions from Sh. Manu Sharma, Superintendent, office of Jandiala Canal and Ground Water Division, Amritsar submits that the decree dated 31.07.2012 passed by the Ld. Trial Court and thereafter by the Ld. Lower Appellate Court dated 10.07.2014 stands satisfied by the appellants-State of Punjab inasmuch as the relief granted therein was released to the respondent-plaintiff/Gulzar and in the wake of this fact, he does not wish to pursue the present appeal any further. He further points out that the respondent-plaintiff has already passed away unfortunately during the pendency of the present appeal.

In the light of above, prayer made by learned State counsel is accepted and the present appeal is ordered to be dismissed as not pressed. ( SANDEEP MOUDGIL ) JUDGE 16.10.2024 manoj
