For the reasons stated in the application, which is duly supported by an affidavit, the same is allowed and the delay of 52 days in filing the application for restoration of the main writ petition. CM-6986-CWP-2023 This is an application under Order 9 Rule 9 of the CPC for restoration of the main writ petition which was disposed of on 27.01.2023.

This is a Civil Writ Petition filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the official respondents to take action against respondent No.5 as per enquiry report submitted by DDPO, Patiala (respondent No.4) to respondent No.3.

Learned counsel for the petitioner has pointed out that in the present case after the filing of the writ petition, subsequent developments have taken place, inasmuch as, respondent No.5 was dismissed from service vide order dated 17.12.2020 passed by the Director, Rural Development and Panchayat Department, Punjab and on an appeal filed by respondent No.5, the said order was set aside vide order dated 17.03.2023. It is submitted that the petitioner seeks to withdraw the present writ petition with liberty to challenge the orders passed subsequently, in accordance with law.

In view of the above, the present writ petition is dismissed as withdrawn, with the aforesaid liberty.

Pending application, if any, stands disposed of in view of the above.
