The instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioners, who are related as mother and daughter, during the pendency of trial, who have been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of Petitioners FIR No.

In regard to the incident dated 15.06.2025, at about 10.15 p.m., said FIR was got registered at the instance of complainant - Sukhdev Singh.

As per allegations, Veer Kaur @ Veer (petitioner No. 1); her nephew Jobanpreet Singh, armed with brick; Billa, armed with pistol; Manpreet Singh, armed with Baseball bat; Arshdeep Singh, armed with wooden stick; and 6-7 unknown persons, armed with .12 bore pistol, started thumping the main gate of the house of the complainant. When complainant came out of the house, petitioner No. 1 - Veer Kaur @ Veer raised a Lalkara to teach lesson for performing witchcraft. In the meanwhile, petitioner No. 2 - Billan @ Sonian @ Sonaian pushed the complainant down and then started beating him. Co-accused Billa fired shots with his pistol and one of the bullet hit on the right side of chest of Kirandeep Kaur, who is daughter of the complainant.

Second shot was fired by one unknown person with countrymade pistol, pallet of which hit on the head of Shamsher Singh (brother-inlaw/Sadhu). Co-accused Manpreet Singh also attacked on daughter and brother-in-law with Baseball bat. Arshdeep Singh hit them with a wooden stick and maternal cousin of the complainant, namely, Janga Singh, was hit on his head with a brick by Jobanpreet Singh, causing serious injuries. 3.

Learned counsel for the petitioners argues that as per allegations, petitioner No. 1 raised only a Lalkara to teach lesson, and, thus, no injury has been attributed to her. Even during investigation, nothing was recovered from her possession. Further argues that petitioner No. 2 is not even attributed any role in the incident, and she has been unnecessarily involved in the case. Co-accused Bakshish Singh and Ranjit Singh, who were also not attributed any role, and considering disability Ranjit Singh, as well as 79 years of age of Bakshish Singh, they have been ordered to be released on bail by the trial Court itself.

Learned counsel for the petitioners also submits that the petitioners are inside jail since 16.06.2025, i.e. for a period of 4 months and 9 days. Thus, prays for grant of bail to the petitioners. 4.

Learned State counsel filed the status report dated 25.10.2025, in the Court today, which is taken on record. Office to tag the same at appropriate place. A copy thereof has been handed over to the counsel for the petitioners. As far as allegations of the prosecution, as pointed out by petitioners' counsel are concerned, the same have not been disputed seriously by the learned State counsel.

As per the status report, after completion of investigation, final report under Section 193 of BNSS qua the petitioners was presented on 28.09.2025 and the charges are yet to be framed. However, investigation qua remaining accused is still going on and they are no even arrested so far. No other case has been registered against the petitioners and they are inside jail since 16.06.2025.

After hearing learned counsel for the parties and perusing the relevant material on record with their able assistance, this Court finds substance in the submissions made by learned counsel for the petitioners by observing that petitioner No. 1 Veer Kaur @ Veer is alleged to have given a Lalkara, whereas petitioner No. 2 Billan @ Sonian @ Sonaian has not been attributed any specific role except of giving a push to the complainant. Coaccused, namely, Bakshish Singh and Ranjit Singh, have already been released on bail. Both the petitioners are inside jail since 16.06.2025, i.e. for a period of 4 months and 9 days.

Taking the circumstances in entirety, the allegations levelled against the petitioners, and the total incarceration period of both the petitioners, i.e. 4 months and 9 days, I deem it appropriate to grant the concession of bail to the petitioners.

Consequently, prayer made in the present petition is allowed. Petitioners are ordered to be released on bail, subject to furnishing of bail/surety bonds by each one of them, to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 9.

Needless to observe that the petitioners shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly.

Any of the discussion done and recorded hereabove, shall not be construed as an expression of opinion on the facts of the case. Therefore, Trial Court is expected to decide the case by taking an independent view, on the basis of evidence available on record, as expeditiously as possible, in accordance with law.

Petition stands disposed of.
