ANIL KSHETARPAL, J(Oral) Defendant-appellant is in the regular second appeal against the concurrent findings of fact arrived at by the courts below while decreeing the suit for recovery of Rs.1,12,496/- on the basis of account books, ledger maintained by the plaintiff-firm.
Plaintiff in order to prove those entries have produced on file entries of the ledger for the years 2006-07 (Ex.P7 to Ex.P83A), 2007-2008 (Ex.P93 to Ex.P142) and 2008-2009 (Ex.P151 to Ex.P155). In the written statement, the defendant did not dispute transactions between the parties but however stated that the entire amount has been paid. However, the defendant could not produce any evidence to support that plea.
Although, learned counsel for the appellant has made sincere attempt to persuade this court to take a different view, however, keeping in view the overwhelming evidence available on the file, which has been correctly appreciated by the courts below, this Court does not find any good Naresh Kumar 2018.05.03 14:29 I attest to the accuracy and integrity of this document Chandigarh
