To be referred to the Reporters or not ?
3.
Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.
Delay of 205 days in filing the appeal is condoned. 2.
An untenable plea raised by the plaintiff to contest the sale executed by the mother was dismissed recording an admission by the plaintiff that the property sold by the mother was a property allotted to her in the partition in the year 2002 and that the plaintiff was himself in possession of the property which was alloted to him. There was no merit in the plea to impeach the sale made by the mother in respect of the property allotted to her. The suit and the appeal were correctly dismissed.
3.
There is no merit in the second appeal. The second appeal is dismissed as devoid of merit.
