The petitioner through instant petition under Article 226 of Constitution of India is seeking setting aside of order dated 20.02.2023 (Annexure P-5) whereby the petitioner-mill has been blacklisted for 03 years.

Learned counsel for the petitioner, at the outset, submits that the petitioner has preferred an appeal before the appellate authority and it is still pending. The grievance of the petitioner, at this stage, would be redressed if respondent is directed to decide his appeal in a time bound manner.

Learned State counsel, who on advance notice is present in Court, submits that the appellate authority would decide appeal of the petitioner by Friday i.e. 06.10.2023.
