**** JAGMOHAN BANSAL , J. (Oral) The petitioner and respondent solemnised marriage on 16.11.2011 and from this wedlock, one male child was born. The couple could not enjoy the fruits of married life and they parted their ways. The wife filed a petition under Section 125 Cr.P.C. seeking maintenance which came up for consideration before Principal Judge, Family Court, SAS Nagar, Mohali. The Family Court vide order dated 22.09.2022 granted interim maintenance of Rs.7,000/- per month to wife and Rs.5,000/- per month to minor child.

CRR(F)-1116-2022 and other connected matter -2The husband [CRR(F)-1352 of 2022] as well as wife [CRR(F)- 1116 of 2022] have come up before this Court assailing the impugned order dated 22.09.2022. The husband is claiming that the amount of maintenance is on the higher side whereas the wife is claiming that it is on the lower side. On being confronted with the fact that maintenance granted is interim, learned counsel for the parties agreed not to press their petitions, however, prayed that the Family Court may be directed to finally determined the amount of maintenance without being influenced by observations made in the order granting interim maintenance.

Without commenting on the merits of case, the petitions stand disposed of with a request to the Family Court to expeditiously adjudicate the question of maintenance and preferably within 08 months from today. The Family Court is further requested to consider all the arguments raised by both the parties and pass order without being influenced by observations made in the interim order.

A photocopy of this order be placed on the file of other connected case.
