(ORAL) Plaintiff is in second appeal against the concurrent judgments and decrees of the learned Courts below, whereby suit filed by the appellant for declaration with consequential relief of permanent injunction restraining the defendants from alienating the suit land, has been dismissed by both the Courts below.

Present appeal is of the year 2014; in which notice in the application for condonation of delay was issued vide order dated 17.08.2015; and in the main Appeal vide order dated 16.02.2018. In the interregnum, the matter has been adjourned due to non-appearance of learned counsel for the appellant on 22.03.2016, 24.09.2019 and 10.01.2023; and at request of learned counsel for the appellant on 05.07.2017, 09.02.2018 and 05.07.2023. RSA-5896-2014 (O&M) - 2A bare reading of the above facts shows that the appellant has exhibited an utterly casual and careless attitude in his pursuit of the present litigation. It is to be appreciated that very valuable public time of the Court has been expended in affording opportunities to the appellant in the interest of justice. It is clear that neither the appellant nor his counsel is seriously interested in pursuing the present matter. Thus, this Court is left with no other option except to dismiss the same for non-prosecution. Ordered accordingly.
