The petitioner has approached this Court seeking grant of regular bail in a case registered vide FIR No.70 dated 30.8.2019 at Police Station Fattudhinga, District Kapurthala under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985.

The case of the prosecution is that on 30.8.2019 the petitioner was found in possession of 278 intoxicants tablets. Upon chemical examination of the said tablets, the same were found to contain 'Alprazolam'. 3.

It is not disputed that the total weight of the recovered contraband would fall within the quantitative limits of 'non-commercial' quantity. 4.

The learned State counsel has, however, opposed the petition on the ground that the petitioner happens to be involved in 5 other cases including 4 under PANKAJ KAKKAR 2020.02.24 17:56 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-44911-2019 (O&M) NDPS Act. It has, however, informed that the petitioner has been behind bars since the last about 6 months.

Having regard to the facts and circumstances of the case especially that the petitioner has been behind bars since the last about 6 months, further detention of the petitioner will not serve any useful purpose as conclusion of trial is likely to take some time. The petition, as such, is accepted and the petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
