ARUN MONGA, J. (ORAL) Present petition has been filed under Section 438 of Code of Criminal Procedure, 1973 (for short 'Cr. P.C.') for grant of anticipatory bail to the petitioner in case FIR No.12 dated 03.11.2021, registered under Sections 120-B, 201, 406, 420, 467, 468, 471 of IPC and Section 3 of Haryana Protection of Interest of Depositor in Financial Establishment Act, 2013, at Police Station Cyber Crime, Hisar region. 2.

Learned counsel for the petitioner submits that pursuant to earlier order dated 16.11.2022 passed by this Court, petitioner has joined investigation and has fully cooperated in the same.

Learned State counsel has filed status report in the course of hearing which is taken on record. He, on his instructions from SI Sourav submits that though petitioner has joined investigation but recovery is yet to be effected. 4.

In any case, recovery is matter of trial and custodial interrogation of petitioner is not required at this stage.

In view of the above, since custodial interrogation of petitioner is no more required and he has already joined investigation, present petition is allowed. Order dated 16.11.2022 granting interim anticipatory bail to the petitioner is made absolute, subject to petitioner's complying with provisions under Section 438(2) Cr.P.C.
