Learned counsel for the appellant has informed the Court that the judgment and decree dated 29.09.2003 rendered in Civil Suit No.891 of 2003 titled as 'Bhoop Singh V/s Mahadevi' was assailed by Mahadevi and she was not successful.
The present regular second appeal is arising out of the civil suit filed by Devi Lal being collateral of Mahadevi. In view of the fact that once sufferer of the decree has not been successful, the co-owner had no better chance. Moreover the both the Courts below have dismissed the suit. The appeal is also accompanied by application seeking 499 days in refiling. The reasons given in the application are not plausible. In view of above, I do not find any illegality and perversity in the judgments and decrees of the Courts below, much less, no substantial question of law arises for determination.
