AT CHANDIGARH **** RSA-266-2018 (O&M) Date of Decision.:12.12.2024 Veeri Kaur @ Lachhmi Kaur @ Balwinder Kaur Pe66oner Vs.

Prem Singh and Others Respondents

CORAM:

HON'BLE MR. JUSTICE DEEPAK GUPTA

Present:

Mr. Deepak Kohli, Advocate for Mr. Kashish Garg, Advocate for the pe

oner.

**** DEEPAK GUPTA, J. (ORAL) Plain ff- appellant is one of the daughter of Prem Singh. She challenged judgment and decree dated 30.07.1983 suffered by her father Prem Singh in favour of defendant Nos.2 to 4, who are her brothers i.e. sons of Prem Singh. The suit to challenge the decree dated 30.07.1983 was filed a2er 27 years i.e. on 10.09.2010. Prem Singh was impleaded as defendant Nos.1 and it is conceded by learned counsel for the appellant that said Prem Singh supported the impugned judgment dated 30.07.1983. The trial Court as well as the Appellate Court have held the suit to be devoid of any merit and so, accordingly dismissed the suit.

Once it is found that Prem Singh, who could have alleged fraud, if any, has supported the impugned judgment and decree, there is no ground so as to assail the same on the ground of fraud.
