(ORAL) Prayer in the present petition under Section 528 of The Bharatiya Nagarik Suraksha Sanhita, 2023 is for issuance of direction to the official respondent No. 2 to transfer the inquiry, which is pending with the respondent No. 5, initiated with respect of the petitioner's complaint/representation No. 4054/P/SSP dated 07.08.2024 to an officer not below the rank of D.S.P. or SP in order to ensure that the inquiry of aforesaid the complaint/representation be conducted fairly, impartially and properly and FIR be registered against the private respondents under the relevant and appropriate Sections of Indian Penal Code. After arguing for sometime, when this Court is not inclined to interfere; learned counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to take recourse to the appropriate remedy as per law.
