Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent No.2 to give deemed date of promotion to the petitioner at par with others who joined in the merit list of the petitioner in the year of 2010 for the post of Assistant Lineman in view of the judgment of this Court in Garima Jindal vs Haryana Vidyut Parsaran Nigam Limited and another, passed in CWP No.13384 of 2011, decided on 06.08.2012 (Annexure P-1). Further a writ of mandamus has been sought, directing the respondents to grant other service benefits including notional seniority, increments at par with others who were appointed in the same merit list and to release arrears of salary as admissible to the petitioner after fixing his seniority MOHD YAKUB 2025.08.22 16:17 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

CWP-24363-2025 at appropriate place along with 9% interest and also consider the name of petitioner for promotion to the post of Assistant Foreman (AFM) from Lineman at par with others.

Learned counsel for the petitioner submits that he would be satisfied if the representation (Annexure P-10) of the petitioner is decided by respondent No.2 by passing a speaking order in a time bound manner.

Learned State counsel as well as learned counsel for respondents No.2 to 8, appearing on advance notice, submits that they have no objection, in case a direction is issued to respondent No.2 for time-bound consideration and decision of the representation of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondent No.2 is directed to consider the representation (Annexure P-10) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.2. 5.

Disposed of, accordingly.
