The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents to depute them for Upper School Course.

The petitioners are posted as Assistant Sub Inspector in the Technical Services Wing of Punjab Police. They have not been deputed for Upper School Course on account of pendency of CWP No. 18915 of 2023 before this Court.

Mr. Chopra, submits that there is no stay in CWP No. 18915 of 2023, thus, denial of opportunity to depute the petitioners for Upper School Course may cause irreparable loss and mere passing of Upper School Course would not promote them. It will only make them eligible for promotion.

Mr. Dhir, submits that in the ongoing course, the petitioners cannot be considered. The legal notice of petitioner is still pending and their claim would be considered in accordance with law. 5.
In the wake of statement of Mr. Dhir, the present petition stands disposed of with a direction to respondents to consider the petitioners for next Upper School Course. It is made clear that entire exercise would be subject to outcome of CWP No. 18915 of 2023 which is pending before this Court.
