(Oral) The petitioner - Baldeep Singh has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No. 0312 dated 28.09.2022 under Sections 406, 498-A of IPC, registered at Police Station Derabassi, District SAS Nagar, Mohali.

The facts of the case are that the complainant Aarti filed written complaint against her husband Baldeep Singh and in-laws family for the harassment caused to her on account of demand of dowry. It is alleged that she got married with Baldeep Singh on 08.11.2019. Her parents had given dowry articles consisting of gold ornaments, other gifts and costly clothes to the family members of her husband. Her parents had spent Rs. 15-16 lacs on marriage. Her parents had also spent huge money at the time of engagement. Soon after marriage, she noticed that her husband and in-laws family were insulting and criticizing her. 2023:PHHC:058608 CRM-M-52407-2022 -2was beaten up by her husband and mother-in-law to compel her to bring cash of Rs. 2 lacs. She further noticed that her husband was having illicit relationship with her Jethani/sister-in-law. She was physically and mentally harassed and treated with cruelty. Ultimately, she was turned out of the matrimonial home and the matter was reported to the police. Learned counsel for the petitioner argued that he has already joined the investigation as per order dated 15.11.2022. The dowry articles have been recovered. He is ready to abide by the terms of bail order. Learned counsel representing the State has filed detailed status report. However, it is conceded that as per ASI Ashok Kumar, the dowry articles are recovered and this fact is also confirmed by learned counsel for the complainant. He has fully cooperated with the investigating agency and he is not required for any other purpose.

Therefore, considering these facts, the ad interim bail already granted in favour of petitioner - Baldeep Singh vide order dated 15.11.2022 stands confirmed, subject to the conditions enshrined under Section 438(2) Cr.P.C.

The petition is, accordingly, accepted.
