The application is allowed subject to just exceptions and the legal representatives of appellant No. 2 Malook Singh (now deceased) mentioned in para No. 2 of the application are impleaded as party. C.M. No. 5096-C-2018 Application is allowed as prayed for and the main case is taken up for disposal by today itself, in view of the compromise effected between the parties.

R.S.A No. 6183 of 2014 (Annexure A-2).

In view of the above factual position, the appeal stands disposed of and the judgment and decree dated 16.10.2014 is modified in terms of the compromise and the compromise (Annexure A2) is made part of the decree. The appellants/first party as per compromise deed will withdraw the writ petition bearing No.2894-2013 which was filed in Uttarakhand High Court at Nainital and respondents/second party will also give up its claim in the land situated at village Ballu Tehsil and District Karnal and shall have no objection to the title of the said land.
