ANIL KSHETARPAL, J(Oral) On 14.05.2018, on the instructions of the respondent, learned counsel for the respondent had stated that the respondent is ready to vacate the premises provided three months' time is granted. However, the case was adjourned to today as there was some dispute about the arrears of mesne profit.
Today learned counsel for the appellant has submitted that the appellant is ready to forego the arrears claimed with regard to mesne profit provided the respondent hand over vacant possession of the premises within three months from today.
Learned counsel for the respondent has reiterated the undertaking given by the respondent to the aforesaid effect on 14.05.2018. In view thereof, the appeal is disposed of. RSA No.6204 of 2014 (O&M) -2decree passed by the courts shall stand modified. If the respondent does not hand over vacant possession, the appellant shall be entitled to move this Court for launch of appropriate proceedings.
