RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for directing respondents No.1 to 4 to conduct a free and fair investigation in case FIR No.71 dated 27.06.2022, under Sections 420, 467, 468, 471 and 120-B of IPC, registered at Police Station West Sector 11, Chandigarh. Further prayer has been made to direct respondents No.1 to 4 to send the forged documents i.e. Rent agreement dated 23.04.2019, cash receipt dated 01.04.2019 and letter dated 23.04.2019 along with the specimen and admitted signatures of the petitioner for forensic examination to any other Forensic Science Laboratory, in view of the dictum of law enunciated by the Hon'ble Apex Court in the case of Dayal Singh Vs. State of Uttranchal (2012) 8 SCC 263. It is further prayed to direct respondent No.4 to not present the final report in the above mentioned FIR during pendency of the present petition. CRM-M-47826-2024 -2At the outset, it has been submitted by learned State counsel, on instructions from ASI Suresh Kumar, that after investigation, cancellation report has been filed before the concerned Illaqa Magistrate, on 25.09.2024. Learned counsel for the petitioner submits that though the petitioner opposes the cancellation report as tainted investigation has been carried out by the State, however, he submits that petitioner be allowed to take all his pleas before the Court concerned. In view of the statement made by learned State counsel that cancellations report has already been filed in this case, the present petition is disposed of with liberty to the petitioner to take all his pleas before the Court concerned.
