(ORAL) The petitioners have filed the present petition under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail in case FIR No.965 dated 28.10.2022 registered under Sections 294, 406, 420 and 506 of the Indian Penal Code, 1860 at Police Station Assandh, District Karnal.

Learned State counsel, on instructions from SI Kitab Singh, submits that in pursuance of order dated 05.01.2023 passed by this Court, the petitioners have joined the investigation and are no longer required for custodial interrogation.

In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 05.01.2023 granting interim anticipatory bail to the petitioners is made absolute, subject to the conditions laid down in Section 438(2) of the Cr.P.C.
