On 18.03.2025 the following order was passed : 'Learned counsel for the appellants states that he has no instructions in the matter inasmuch as appellant No.1 has died, and his legal representatives are not coming forward.

Let notice be issued to appellant No.2, returnable 02.12.2025.'

As per the Office report, notice issued to appellant No.2 has been received back unserved due to incomplete address. There is no other address available with the Court for effecting service of appellant No.2 except the one mentioned in the memo of parties and in the judgments and decrees passed by both the Courts concerned and is the same on which the notice was sent. 3.

Learned counsel for the appellants today again pleads no instructions in the matter.

In view thereof, this Court is left with no other option but to dismiss the present regular second appeal for non-prosecution. 5.
