(ORAL) CM-2638-C-2021 Present application has been filed under Section 151 CPC read with Order 23 Rules 3 CPC for disposing of main appeal i.e. RSA-3722-2017 in terms of compromise deed dated 19.04.2021 (Annexure A-1) effected between the parties.

Learned counsel appearing on behalf of the respondents do not dispute the execution of the compromise deed dated 19.04.2021 (A-1) between the parties.
In view of the joint request of learned counsel for the parties, the present application is allowed and the hearing of main appeal i.e. RSA-3722-2017 is preponed to today.
Learned counsel for the parties are agreed that the parties have already settled their disputes amicably and have entered into a compromise deed dated 19.04.2021 (Annexure A-1) with their free will and without coercion. Learned counsel for the parties submits that the respective parties will execute the said compromise as per the terms and conditions mentioned therein.
Learned counsel for the appellants submits that in view of the compromise deed dated 19.04.2021 (Annexure A-1), the present appeal be disposed of as having been withdrawn.
