(Oral) The present appeal is directed against the judgments and decrees of both the Courts below, whereby, the suit of 1998 challenging three sale deeds dated 31.07.1989, 12.08.1993 and 06.12.1993 had been dismissed under the provisions of Order 17 Rule 3 of Code of Civil Procedure on the premise that the appellants did not lead any evidence. Even on second call, there is no representation on behalf of the appellants. This case has a chequered history of preliminary hearing. The appeal was listed with caveat for the first time on 06.05.2014 and there was no representation on behalf of the appellants. On 07.07.2014, 03.09.2015, 09.08.2016, 15.05.2017, 11.09.2017 and 01.11.2017, the case was adjourned on the request of counsel for the appellants.
