Petitioner has filed instant petition under Section 482 of BNSS, 2023 for grant of anticipatory bail in FIR No.173 dated 21.04.2022 under


(O&M)


Sections 406 and 506 IPC, registered at Police Station City Tohana, District Fatehabad.

As per facts of the case, FIR is registered on the written complaint of Varun Kumar who stated that he had purchased Breeza car bearing registration No.HR-23G-9940 by taking loan from HDFC Bank. He came in contact with the person namely Haider who allured him to give his car on rent and he will be able to earn money. Complainant came under his influence and agreed to rent out his car. Later-on, Haider did not return his car nor gave any money. He came to know that his car was illegally sold. Through GPS he came to know location of car present at the house of Gora Singh son of Pappu Singh. With these allegations, present FIR was registered.

Learned counsel for petitioner pointed out that he was granted interim bail vide order dated 24.09.2024 and in pursuance of this, he has already joined investigation. Said car is also recovered which is evident from the orders of learned Additional Sessions Judge, Fatehabad dated 28.08.2024 (Annexure P-3). He is not required for any other purpose. Therefore, his anticipatory bail may be allowed. 4.

Status report filed. Aforesaid factual position is confirmed that petitioner has joined investigation and the said car is also recovered. Therefore, petitioner is not required for further investigation. 5.

Considering the aforesaid facts, no purpose would be served by sending petitioner behind the bars, therefore, interim bail already granted vide order dated 24.09.2024 stands confirmed subject to the conditions detailed under Section 482 (2) of BNSS, 2023.
