Petitioner Beant Kaur has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.333 dated 02.09.2024, under Section 21B/29/61/85 of Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station City Mandi Dabwali, District Dabwali. 2.

As per facts of the case, on 02.09.2024, ASI Pritam Singh and police party apprehended one person on the basis of suspicion, who disclosed his name as Bhinder Singh alias Bhinda son of Tej Singh. His search was conducted as per rules and from his possession a white coloured transparent polythene envelope was recovered containing heroin (Chitta) weight 6.15 gm. On the basis of this recovery, present FIR was registered.

  Present petitioner was named in the disclosure statement of Bhinder Singh alias Bhinda.

Learned counsel for petitioner argued that arrest of petitioner was stayed vide order dated 25.09.2024 and she has already joined the investigation. No recovery is effected from her. Alleged contraband was recovered from her husband. She is ready to abide by the terms of bail order. Therefore, her anticipatory bail petition may be allowed. 4.

I have considered the aforesaid factual position. It is not disputed that present petitioner has joined investigation. 5 $+    !   . Alleged recovery was effected from co-accused which falls under non-commercial quantity. Therefore, no purpose would be served by sending the petitioner behind the bars. Accordingly, anticipatory bail petition filed by petitioner -Beant Kaur is allowed. She be not arrested. In case of her arrest, she be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. She will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482(2) BNSS.
