Through the instant petition, the petitioner seeks quashing of the order dated 16.07.2015, whereby, the learned Magistrate concerned has, in FIR No.137 dated 16.05.2013, under Sections 323, 324, 325, 34 of the IPC, registered at P.S. City Sangrur, District Sangrur, declared the petitioner as "Proclaimed Offender".

A Co-ordinate Bench of this Court had, on 19.09.2023, directed the petitioner to, within three weeks therefrom, surrender before the learned Court concerned. Moreover, a direction was also passed that, in case the petitioner surrenders and applies for regular bail, the learned Court concerned shall decide the same on the very day. 3.
On the last date of hearing, i.e. 13.12.2023, since the learned counsel for the petitioner was not present, who is not present even today also, this Court had directed the learned State counsel to inform whether the petitioner has, in compliance of order dated 19.09.2023, surrendered before the learned Court concerned or not.

Accordingly, today the learned State counsel has, on instructions imparted to him by A.S.I. Hakam Singh, informed this Court that the petitioner has not yet surrendered before the learned Court concerned.

What inference this Court is impelled to draw from the hereinabove expressed conduct of the petitioner, is that, the petitioner, who is already declared as "Proclaimed Offender", does not want to abide by the law, inasmuch as, despite grant of adequate protection (supra), he did not surrender before the learned Court concerned, in compliance of the directions (supra) of this Court. Consequently, the instant petition is dismissed.
