(ORAL) The petitioner has preferred present petition under Article 226/227 of the Constitution of India praying for issuance of writ in the nature of certiorari for quashing of the order dated 16.4.2021 (Annexure P-1) whereby the claim of the petitioner was rejected after his appeal was rejected by the appellate authority vide order dated 27.9.2018 being barred by time.

The petitioner was booked vide FIR No. 154 dated 26.05.2006. Based upon almost similar set of allegations he was proceeded against in departmental proceedings which finally culminated in the order of punishment dated 25.05.2007 (Annexure P-5) whereby punishment of forfeiture of three years of approved service with future effect was awarded to the petitioner. CWP No. 29068 of 2022(O&M) Admittedly, petitioner never objected to such proceedings by department during the pendency of criminal case. The criminal trial on the basis of aforesaid FIR resulted in acquittal of the petitioner granting him benefit of doubt. The appeal preferred against the same was also dismissed. Now the petitioner by way of present petition wants to challenge and undo the punishment awarded vide order dated 25.5.2007 (Annexure P-5).

In the considered opinion of this Court, it is too late in the day for the petitioner to re-agitate the matter which already stands concluded way back in the year 2007.
