The present regular second appeal pertains to the year 2018. Since 2018 the case has repeatedly been adjourned on one ground or the other. As far back as on 04.03.2020 a statement was made by the learned counsel for the appellant that since the dispute is between real sisters, notice be issued only for exploring the possibility of a compromise. The parties were directed to appear before the Mediation and Conciliation Centre of this Court on 21.04.2020. However, the mediation could not take place due to Covid-19 Pandemic. Thereafter, on numerous dates, no one appeared on behalf of the appellant, and the matter was adjourned. Vide order dated 06.03.2024 notice of motion was again issued only for the purpose of settlement and the parties were once again directed to appear before the Mediation and Conciliation Centre of this Court on 20.03.2024. Subsequently, the Mediator had sought extension which was granted vide order dated 09.04.2024. Yet again a request AMAN JAIN 2025.09.26 09:38 I attest to the accuracy and integrity of this order/judgment

RSA-3447-2018 (O&M) -2for extension of time was received from the Mediator which was again granted vide order dated 01.08.2024. On 14.11.2024 the Mediator sought another extension of time which was granted and the matter was adjourned to 30.01.2025. On 30.01.2025 no one appeared on behalf of the appellant and it was noticed in the order that the mediation report had been received as per which the matter remained unsettled. It was also made clear that no further adjournment shall be granted on any account.

Today again a request for an adjournment is made on behalf of the arguing counsel for the appellant on the ground that the parties have settled the matter, though no compromise has been placed on the record or shown to the Court. There is no ground to further adjourn the matter especially in view of the facts as noticed above.

Since the counsel for the appellant is not prepared to argue the matter, this Court is left with no other option but to dismiss the present regular second appeal for non-prosecution.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
