**** SANDEEP MOUDGIL , J.(ORAL) This petition has been filed by the petitioner under 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 (Section 482 Cr.P.C., 1973) with direction to respondent Nos.2 and 3 to conduct fair and transparent enquiry/investigation regarding the fraud committed by respondent No.5 by forging/fabricating fake birth certificate and then obtaining passport based on these documents.

The concern raised in the instant petition is qua the fraud committed by respondent No.5 who is alleged to have forged or fabricated birth certificate on the basis of which has allegedly got passport issued. The investigation in the matter is pending since representation made on behalf of the petitioner for the first time on 20.03.2024 (Annexure P-3) and thereafter subsequently dated 11.06.2024 (Annexure P-4) and 18.06.2024 (Annexure P-5).

CRM-M-48428-2024 Without adverting to the merits of the case, the present petition is disposed of with a direction to respondent No.2-Additional Director General of Police, NRI Affairs Wing Punjab, to get examine the representations dated 20.03.2024 (Annexure P-3), 11.06.2024 (Annexure P4) and 18.06.2024 (Annexure P-5) and decide the same in accordance with law within a period of 04 weeks from the date of receipt of the certified copy of this order. The decision shall be recorded by passing a speaking order, a copy of which shall also be furnished to the present petitioner within next one week thereafter.

In the afore-said direction, the present petition stands disposed of.
