Mr.Sawan Choudhary, Advocate for the petitioner.
**** RAKESH KUMAR JAIN, J.
Counsel for the petitioner has submitted that he has filed third party objections before the Recovery Officer and also an application for stay which has not been listed.
We have heard counsel for the petitioner and perused the record.
Once the petitioner has already filed application for stay before the competent authority, we do not find any reason to interfere in this petition, which has been filed by invoking the extra ordinary jurisdiction under Article 226/227 of the Constitution of India. Faced with these observations, counsel for the petitioner has prayed for withdrawal of this petition, in order to file another application before the competent authority to press the application for stay.
