Learned counsel for the appellant submitted that talks of compromise are going on but parties have not arrived at compromise. The case cannot be kept pending for enabling parties to arrive at compromise.

The appeal is dismissed for non-prosecution. However, liberty is granted to the revive the same in case compromise fails.
