Present petition under Section 482 Cr.P.C. is filed seeking quashing of FIR No.128 dated 24.05.2019 under Section 366 IPC registered at Police Station City Sri Muktsar Sahib, District Sri Muktsar Sahib (Annexure P1).
On the last date of hearing i.e. 21.09.2023, learned State Counsel had informed that cancellation report in the present case had been accepted by learned Chief Judicial Magistrate, Sri Muktsar Sahib vide order dated 12.11.2021.
Learned State Counsel files order dated 12.11.2021 which is taken on record. As per the said order, complainant/respondent No.2 has suffered statement that his daughter and the petitioner have solemnized marriage and they are living as husband and wife. Complainant/respondent No.2 has further stated that he is satisfied with the investigation conducted by the police and has no objection if the cancellation report is accepted. As there was no representation on behalf of the petitioner, the matter was adjourned in the interest of justice and Registry was directed to inform learned counsel for the petitioner about the date fixed.
Office report dated 10.10.2023 shows that learned counsel for the petitioner has been duly informed about the date fixed. However, there is no representation on behalf of the petitioner.
Accordingly, in view of above submissions of learned State Counsel, no other direction is required to be issued in the matter, present petition is accordingly disposed of. In case anything survives, it is open to the petitioner to file appropriate application in this regard within three months from today.
