(Oral) Prayer in this first petition filed under Section 439(2) Cr.P.C. is for cancellation of anticipatory bail granted to respondent No.2 herein vide order dated 29.9.2021 (Annexure P-2) passed by learned Additional Sessions Judge, Amritsar in case FIR No.197 dated 03.09.2021, under Sections 323, 452, 295, 354-B, 355, 427, 506, 148, 149 and 120-B IPC (Sections 325 IPC added later on vide G.D. No.4 dated 16.09.2021 and Section 354 IPC as well but Sections 452, 295, 354-B, 148, 149 and 120-B IPC deleted), registered at Police Station Commissionerate Amritsar.

It is contended by learned counsel for the petitioner that after grant of anticipatory bail by the learned Additional Sessions Judge, Amritsar vide order dated 23.9.2021 (Annexure P-2), which was absolute vide order dated 29.9.2021 (Annexure P-3) by the learned VIJAY ASIJA 2024.02.28 20.03 I attest to the accuracy and integrity of this document

2024:PHHC:028168 CRM-M-51223-2023 Additional Sessions Judge, Amritsar, the respondent No.2 has misused the concession of anticipatory bail. However, learned counsel for the petitioner accepts that these facts were not brought to the knowledge of the learned Additional Sessions Judge, Amritsar. In view of the aforesaid, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to approach the learned Additional Sessions Judge, Amritsar, if so advised.

Permitted to do so.
