(ORAL) By way of present petition filed under Section 439 Cr.P.C. prayer has been made for grant of regular bail pending trial in case of FIR No. 65 dated 21.05.2022 (P-1) registered under Sections 419, 420, 120-B IPC registered at Police station Sector-26 East, Chandigarh. Referring to the FIR, learned counsel for the petitioner submits that petitioner is a young boy of 21 years of age who landed up in the present case. Learned counsel for the petitioner further submits that petitioner is already behind bars for the last almost 8 months now, and the investigation stands concluded and the trial is also at final stage thus, the petitioner be granted the concession of regular bail. On the other hand, learned State counsel submits that trial in the present case is almost over as evidence of both sides have already been recorded and the matter is now listed for final hearing. Keeping in view the fact that the petitioner is a young boy of 21 years of age with no other case of similar nature to his credit and is already behind bars for the last almost 8 months, mere fact that the trial is going to conclude soon cannot be a bar for granting regular bail so as to extend the incarceration of the petitioner. Moreover, allegations against him are yet to be established in the Court of law.

In view of the above, without expressing any opinion on the merits of the case, the present petition is allowed.
