The counsel appearing for the respondent husband says that he is proposing to have the application for restitution of conjugal rights filed under the provisions of the Hindu Marriage Act dismissed as withdrawn.

Having regard to the statement made, there is no requirement for transfer. The transfer application is disposed of and the respondent will be barred from prosecuting the case for restitution of conjugal rights. The statement of counsel is done at the instruction of the party who is present in Court and this order is directed to be communicated to the Court before which Section 9 petition is pending so that it shall not proceed to take up the case.

The transfer application is disposed of with the above observations.
