CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J. (ORAL) The application has been filed seeking review of the order dated 19.09.2016. While disposing of the revision petition, this Court had granted the interim injunction qua changing the nature of the land during the partition proceedings. It has been brought to the notice of this Court that preliminary decree has been passed.

In view of such situation, there cannot be any order regarding interim injunction in civil suit. The order of injunction was also in vogue till the pendency of the partition proceedings. One hand the review petitioners are assailing the partition proceedings and another hand asking for keeping the land reserved and raise construction at their own peril. The same does not stand on touchstone of equity.

There is also delay of 62 days in filing the review application but no satisfactory explanation has come forth for seeking condonation of delay. No ground for interference is made out, much less, found any error apparent on the face of the record.

The review application is dismissed both on account of delay and as well as on merits.
