**** RITU BAHRI , J. (Oral) Challenge in this petition is to order dated 10.10.2019 (P-7) passed by learned District and Sessions Judge, Ambala vide which the application filed for sending requisition for video conferencing was dismissed and evidence of the petitioner was closed by order.
Learned counsel submits that the petitioner moved an application before Family Court, Ambala for recording of his evidence through video conferencing and vide order dated 23.05.2018, the learned Family Court allowed the petitioner to participate in the proceedings through video conferencing (P-3). Accordingly, the petitioner filed an application before District and Sessions Judge, Indore for grant of permission to mark appearance before Family Court, Ambala through Video Conferencing (P-4), which was declined vide order dated 11.09.2019 (P-5) on the ground that no such request has been received in the Court of learned Sessions Judge, Indore. Thereafter, the petitioner again moved an application dated 10.10.2019 (P-6) before the Computer Incharge Officer, Family Court, Ambala to send a requisition through registered post addressed to GAURAV ARORA 2019.10.31 11:41 I attest to the accuracy and integrity of this document Chandigarh
C.R. No. 6740-2019 Incharge (Video Conferencing) District and Sessions Court, Indore for arranging video conferencing on specific date. The said application has been dismissed on 10.10.2019 and evidence of the petitioner was closed. Keeping in view the fact that the learned Family Court allowed the petitioner to participate in the proceedings through video conferencing vide order dated 23.05.2018 (P-3), the order dated 10.10.2019 (P-7) is set aside. A direction is being given to the Family Court, Ambala to send requisition to Family Court, Indore for video conferencing of the petitioner.
