ARVIND SINGH SANGWAN J. (Oral) Prayer in this petition is for issuance of direction to the Chief Judicial Magistrate, Jalandhar to decide the petition filed by the petitioner under Section 156(3) Cr.P.C. bearing No.710/2021 titled as "Rita Bamni vs Rajinder Kumar, etc." within a time bound manner. Counsel for the petitioner has argued that in a complaint filed by the petitioner under Section 156(3) Cr.P.C. (Annexure P-12), the case is still at the pre-cognizance stage and the Illaqa Magistrate is simply adjourning the case.

In view of the above, the present petition is disposed of with a direction to the Chief Judicial Magistrate, Jalandhar, to pass an appropriate order either at the pre-cognizance stage under Section 156(3) Cr.P.C. or by taking cognizance under Section 190 Cr.P.C., within a period of 02 months from today.
