Mr. Navdeep Singh, Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) The petitioners are seeking the concession of anticipatory in FIR No.137 dated 23.06.2024 under Sections 406, 420 and 120-B of the Indian Penal Code, 1860, registered at Police Station Patran, District Patiala.

Learned counsel for the petitioners submits that in compliance of order dated 13.11.2024 passed by a coordinate Bench, the petitioners have not only deposited an amount of 5 lakh before the ₹ learned trial Court, they have also joined and cooperated with the investigating agency. In support, learned counsel has placed on record photocopy of E-Challan. The relevant part of order dated 13.11.2024 reads as under:

"During the course of arguments, learned counsel for the petitioners submitted that the matter infact arises out of a civil transaction between the parties and that the petitioners, in any case, are willing to amicably resolve the matter on some reasonable terms. CRM-M-48279-2024 -2submitted that the petitioners, in order to prove their bona fides, shall deposit an amount of Rs.5 lakhs before the Trial Court.

In view of the aforesaid submissions made on behalf of the petitioners, the matter is adjourned to 28.2.2025.

The petitioners, as per their offer, shall deposit an amount of Rs.5 lakhs before the Trial Court/Illaqa Magistrate within a period of 3 weeks from today. Upon deposit of such amount, the Trial Court/Illaqa Magistrate shall get the same invested in some FDR with some Nationalized Bank with a specific direction to Manager of the bank concerned not to entertain any request for encashment of the same except under orders of the Court."

Learned State counsel, on instructions from S.I. Gurmeet Singh, does not dispute the factum of the petitioners having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioners are not required for further investigation much less for their custodial interrogation. 4.

In view of the above, the petition is allowed and interim order dated 13.11.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
