The petition for transfer is sought by the wife from the Court at Mohali to the Court at Ludhiana on a plea that she has no one to support except her brother who is working in Chandigarh and it will be very difficult for her to conduct the cases at Mohali. The petitioner would state that she has herself filed application for maintenance before the Court at Ludhiana and she has also given a complaint for cruelty and a case is pending under Domestic Violence Act before the Court at Ludhiana. The husband's contention is that both these complaints for maintenance and complaint of domestic violence have been made by the wife after the matrimonial proceedings initiated by the husband in Court at Mohali. T.A.No.157 of 2014 -2connected from Mohali, she ought to have no difficulty in going to Mohali for contesting the case. The petitioner will, however, be paid ` 500/- as transportation expenses for every effective hearing when she shows up for hearing and the Court will ensure that it does not take up trial or call the petitioner to file a reply without the husband complying with the direction for defraying the transportation expenses for herself and for escort who may go along with her. This will be independent of any maintenance which the wife is at liberty to secure on an application under Section 24 of the Hindu Marriage Act or in the proceedings under Section 125 Cr.P.C which is said to be pending before the Court at Ludhiana.
