NARESH KUMAR SANGHI, J (Oral) Learned counsel for the petitioner submits that though the respondent has effected a compromise with the petitioner, but as per the terms and conditions of the compromise the petitionerhusband has not yet withdrawn the petition filed under Section 9 of the Hindu Marriage Act, 1955. He submits that he may be permitted to withdraw the present petition at this stage with liberty to the petitioner to file a fresh petition, if need be.
