The instant petition has been filed for quashing of impugned order dated 10.07.2025 (Annexure P-5) passed by learned Additional Sessions Judge-1, Jalandhar, whereby non-bailable warrant of arrest has been issued against the petitioner for 26.08.2025. 2.
Learned counsel for the petitioner contends that the petitioner was regularly appearing before the learned trial Court on all previous dates of hearing and on 10.07.2025 his non-appearance was neither willful nor deliberate but solely due to unavoidable personal reasons, as he had to go out of station. The petitioner had duly instructed his counsel to move an application for exemption from personal appearance for that date, however, the learned Trial Court declined the request and, without affording an opportunity of hearing to the petitioner, it proceeded to cancel his bail and issued non-bailable warrants.

On 10.07.2025, no prosecution witness was present. Due to non-appearance of the petitioner, trial was not delayed and the petitioner is ready to surrender himself before the trial Court on the next date of hearing i.e. 26.08.2025.

Keeping in view the above facts and circumstances of the case, the petitioner is directed to surrender himself before the trial Court and if he surrenders before it on the date fixed i.e. 26.08.2025, the trial Court will take a lenient view while deciding his application for bail. 6.
Disposed of accordingly.
