Petitioner, who has been arrayed as co-accused in case bearing FIR No.89 dated 07.06.2025 registered against him, for commission of offences punishable under Section 5/13(2) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 at Police Station Bichhore, District Nuh, prays for grant of pre-arrest bail. 2.
On 19.08.2025, following order was passed by this Court:- "Petitioner, who has been arrayed as co-accused in case bearing FIR No.89 dated 07.06.2025 registered under Section 5/13(2) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 at Police Station Bichhore, District Nuh, prays for grant of pre-arrest bail.
Learned counsel submits that petitioner has been falsely implicated in the present case. Hamid son of Rehmat, a covillager, who was nursing a grudge against petitioner and other accused gave false information against them that they are indulging in cow slaughter. Hamid only wanted to level scores with the accused. Taking his submissions further, learned counsel submits that relying upon the information given by Hamid, ASI Yashpal along with other police officials reached the site disclosed (house) where they found two oxen. At the said time, the house was in possession of Rashid and Nafish. Learned counsel submits that petitioner whose past antecedents are quite clean (being not involved in any other criminal case) is willing to join the investigation as and when called for by the IO.

Needful be done well before the date fixed with an advance copy to the counsel opposite.
In view of the submissions advanced by learned counsel for the petitioner, but without expressing any opinion on the merits of the case, the petitioner is hereby directed to join investigation within seven days from today and co-operate in the same. In the event of the arrest of the petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 482(2) BNSS."

Pursuant thereto, the status report by way of affidavit of Mr.Jitender Kumar, Deputy Superintendent of Police, Punhana has been placed on record. In para 7 thereof, it has been specifically mentioned that petitioner has joined the investigation on 24.08.2025. 4.
Submissions of both learned counsel heard. Documents perused.

Keeping in view the fact that petitioner has joined the investigation, interim bail granted vide order dated 19.08.2025 is hereby confirmed, subject to conditions as envisaged under Section 482(2) BNSS. Further the petitioner is directed to join investigation as and when required in future by way of written notice for such purpose to be served by Investigating Officer of this case upon the petitioner; he will not tamper with the evidence nor will influence the witnesses and will not leave the country without prior permission of the Court.

The petition stands allowed.
